Your privacy is respected at Orange USA Inc. dba emaqi ("Orange", "emaqi", "we", "our", or "us"). This Privacy Policy ("Privacy Policy") describes the types of information, including Personal Data, that we gather from you when you use our website (including https://orange.inc/), and other services (collectively our "Service"), as well as your choices regarding use and disclosure of your Personal Data.

As used in this Privacy Policy, "Personal Data" means information that identifies you or can be used to identify you, directly or indirectly, by reference to identifiers such as your name, identification number, location data, online identifier, or one or more factors specific to your physical, physiological, genetic, mental, economic, cultural, educational, commercial, professional, or social identity.

By accessing our Service, you acknowledge that your Personal Data will be processed in accordance with this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use our Service. Each time you use our Service, the current version of the Privacy Policy will apply. Accordingly, whenever you use our Service, you should check the date of this Privacy Policy and review any changes since the last version. A. Personal Data Collected by Orange

When you use our Service, Orange collects information: (i) that you knowingly provide when you use our Service, including registration and account setup information; (ii) that we are able to collect based on your use (such as analytics details), including by using cookies and other similar technologies; and (iii) that we collect from third parties where they share Personal Data about you.

In the preceding 12 months, Orange has collected the following:

1. Personal Data that you knowingly and willingly provide.

How Orange collects Personal Data about you depends on how you interact with our Service. The following are the categories and types of Personal Data that we collect:

  • Identifiers date of birth, email address, or other identifier that permits the physical or online contacting of a specific individual, account name, other similar identifiers.
  • Commercial Information – payment information, including credit and/or debit card information and zip code, purchase information, including content and the time of purchase.

2. Personal Data that we collect based on your use (including via cookies).

  • Device Information and Other Unique Identifiers – IP address, browser type, operating system, location data and local time zone, date and time of each visitor request (e.g., logs of web pages selected and time spent on each page), referring site and/or search engine, device type (e.g., desktop, laptop, tablet, phone, etc.), mobile network and the device’s telephone number. screen size, color, depth, and system fonts, language preference.
  • Internet or Other Network Activity – Including browsing or search history, traffic history and information regarding your interactions with our Service, emails, or advertisements.

Cookies. Orange may obtain information about you by installing “cookies” on your computer’s hard drive (with your consent, where required by applicable law). We use cookies to collect statistical information about the ways visitors use our Service including which pages they visit, which links they use, and how long they stay on each page. Orange may also use cookies to create a database of your previous choices and preferences, saving you time and effort.

If you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer. If you limit or disable the use of cookies when you visit Orange’s Service, you may be unable to use the full functionality of our Service. With your consent, where required, we may also permit select third parties to use cookies to collect information about our Service visitors for analytics and targeted advertising purposes.

3. Personal Data collected from third parties.

We may also collect and store Personal Data that is provided to us by others. If you or other users use our Service to upload, share, or distribute content (including videos, comments, or other submissions), and such content contains Personal Data about you or others, such information may be stored to allow for such uploading, sharing, or distribution.

As a requirement to use our Service, you acknowledge that you have consent from any individual (or the parent of any child under the age of 16) to share their Personal Data with us. We may also receive your Personal Data from trusted third parties (including, for example, business partners, subcontractors in technical, payment, and delivery of membership services, advertising networks, or analytics providers).

Sensitive Information. We only collect sensitive Personal Data, as defined by applicable privacy laws, for the purposes allowed by law or with your consent. We do not collect or process sensitive Personal Data for the purpose of inferring characteristics about you.

B. How is Your Personal Data Used?

We may use Personal Data we collect about you on its own or combine it with other information we have about you for the following business or commercial purposes:

  • Create user accounts and/or profiles through registration;
  • Perform internal operations, such as tracking and improving the effectiveness of our website, mobile experience, and marketing efforts;
  • Provide product and/or Service fulfillment, such as creating and maintaining accounts, managing purchases, payments, and more;
  • Personalize user experiences, such as remembering your settings and preferences for things like language, font size, etc.;

C. How We Disclose the Personal Data We Collect

We will only transfer your Personal Data to third parties who provide sufficient guarantees regarding the technical and organizational security measures governing the processing to be carried out and who can demonstrate a commitment to compliance with those measures.

Where third parties are processing Personal Data on our behalf, they will be required to agree, by contractual means or otherwise, to process the Personal Data in accordance with the applicable law and to act only on our instructions, or as permitted by law.

Orange may disclose your Personal Data to the following entities and for the listed business purposes:

  1. Agents and Service Providers. Other companies and individuals including agents, contractors, vendors, and service providers to perform functions on our behalf. Examples of such functions include fulfilling orders, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing technical support, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. We share our users’ Personal Data with agents as we deem necessary for such third parties to perform their functions.
  2. Affiliates. When you are asked for information while on our Service, you are sharing that information with Orange Inc., our parent company based in Japan, and our various affiliates, unless stated otherwise. As a result of this sharing, you may receive communications from any of our affiliates.
  3. Authorized Business Partners. These include, licensors, resellers, system integrators, etc. Orange, our affiliates, and our business partners may share Personal Data with each other and use it consistent with this Privacy Policy. Orange and our authorized business partners may also combine Personal Data with other information to improve our products, the Service, content, and advertising.
  4. Authorized Business Partners, Advertisers, Agents, and Promotional Offers. We may enter into alliances, partnerships, or other business arrangements with third parties to share Personal Data for the purpose of providing you with information regarding products and services that we think may be of interest to you (with your consent, where required under applicable law). We may also share your information with third-party partners for them to better target products and services to their customers.
  5. Other Users. Please remember that any information you share in public areas of the Service, such as message boards or feedback sections, becomes public and anyone may take and use that information. Please be careful about what you expect to keep private. If your Personal Data is posted in any public areas of the Service, you may contact us through our customer service representatives to request to have such information removed.
  6. To Comply with Legal Process, Protect Orange, or Enforce our Rights. We may disclose your Personal Data when necessary to conform to legal requirements or comply with legal process; enforce or apply our conditions of use and other agreements; protect the rights, safety, or property of Orange, our affiliates, service providers, our users or the public; or to prevent a crime or protect national security (including exchanging information with other companies and organizations for fraud protection and credit risk reduction).
  7. As Part of a Merger or Sale of Business. We may disclose your Personal Data in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

D. Sell, Share, Targeted Advertising

We may sell your Personal Data, as defined in privacy laws in certain local jurisdictions. Although we do not “sell” Personal Data for monetary consideration, we use your Personal Data for targeted advertising, which may constitute a “sale”, “share.” In the previous twelve months we may have sold your Identifiers and your Internet or Other Network Activity to advertising and social media networks for targeted advertising purposes. You may have the right to opt out of the sale, share, or targeted advertising depending on where you reside. To opt out of the sale or share of your Personal Data, please refer to the section titled, “Your Personal Data Rights” below.

E. International Users

We are headquartered in the United States. Your Personal Data may be accessed by us or transferred to us in the United States or to our affiliates, partners, merchants, or service providers who are located worldwide. If you are visiting our Service from outside the United States, be aware that your information may be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated and that the United States currently does not have uniform data protection laws in place.

We will protect the privacy and security of Personal Data according to this privacy statement, regardless of where it is processed or stored; however, you explicitly acknowledge that Personal Data stored or processed in the United States will be subject to the laws of the United States, including the ability of governments, courts of law, or enforcement or regulatory agencies of the United States to obtain disclosure of your Personal Data.

F. Security

We maintain reasonable industry security measures to safeguard against loss, theft, interference, and misuse, as well as unauthorized access, disclosure, alteration, or destruction of your Personal Data. We also maintain procedures to help secure online sessions and to protect Orange accounts and systems. This approach helps ensure that information remains safe and private, however, you should understand that no data storage system or transmission of data over the internet or any other public network can be guaranteed to be 100% secure, accurate, complete, or current.

G. Storage and Retention

The Personal Data that you provide us is generally stored on Google Cloud Platform servers located in the United States.

Orange will retain your Personal Data for as long as needed to provide you with the Service. If you wish to request that we no longer use your Personal Data to provide you with the Service, you may contact us at support@emaqi.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

H. Site-Specific Terms

  1. Do Not Track Policy. Except as otherwise provided in this Privacy Policy, we do not use technology that recognizes a do-not-track signal from your web browser.
  2. Marketing. By consenting to this Privacy Policy, you agree to receive marketing materials from us where this is permitted under applicable law. If Personal Data is collected by us for marketing purposes, we will usually inform you before collecting your data or sharing it for third party purposes. You can prevent the processing of your Personal Data for these purposes by checking certain boxes on the forms we used to collect your personal data. Additionally, if you prefer not to receive marketing messages from us, please let us know by clicking on the unsubscribe link within any marketing message that you receive, or by sending a message to us at support@emaqi.com. Where you are located in a jurisdiction that requires us to obtain your express consent for marketing communications, we will not send you any marketing communications unless we have obtained such consent or are otherwise lawfully permitted to.
  3. Links to Third-Party Services. Our Service may contain links to third-party websites, applications, and services not operated by us. These links are provided as a service and do not imply any endorsement by Orange of the activities or content of these sites, applications, or services nor any association with their operators. Orange is not responsible for the privacy policies or practices of any third party including websites or services directly linked to our Service. You should review any such linked site’s privacy policies before submitting any of your Personal Data to such third parties, as we are not responsible for and have no control over information that is submitted to, or collected by, these third-party sites.

I. Minors and Children’s Privacy

The Service is not intended for children under 13 years of age and we do not knowingly collect Personal Data from children under 13 without parental consent. To access certain parts of our Service, we may require information for purposes of age verification so we may ensure the Service is not available to children under 13. In these cases, we do not knowingly collect Personal Data from children.

J. Your Personal Data Rights

You may have certain rights and choices regarding our processing of your Personal Data. Depending on your jurisdiction, applicable law may entitle you to additional consumer rights, including the right:

  • To know the categories and/or specific pieces of Personal Data collected about you, including the source of your Personal Data, whether your Personal Data is sold or disclosed and the purpose, and with whom your Personal Data was disclosed;
  • To request deletion of Personal Data, if permissible by law;
  • To correct inaccurate Personal Data we retain about you;

  1. Exercising Your Right to Know, Delete and Correct. You may exercise the right to know (sometime also referred to as the right to access), delete, and correct by submitting a verifiable request by contacting us using the contact information at the end of this Privacy Policy or by filling out this form.
  2. Opt-Out of Sale, Share, and Targeted Advertising. We and our third–party partners use cookies, and other similar online tracking technologies (collectively, “online tracking technologies”) to gather information when you interact with our Service. These online tracking technologies may be deemed to be a “sale” / “sharing” / “targeted advertising” under certain privacy laws. To opt-out of these online tracking technologies by submitting a request via “Do Not Sell or Share My Personal Information.
  3. The Right to Limit the Use of Sensitive Personal Data. Orange does not process Sensitive Personal Data for the purpose of inferring characteristics about you. Therefore, Orange does not offer the right to limit the use of Sensitive Personal Data.
  4. Right to Appeal a Decision. Depending on where you reside, you may have the right to appeal a privacy decision. To do so, contact us at the information listed below under “Privacy Inquiries.”

Depending on where you reside, you may designate an authorized agent to submit a request on your behalf regarding your Personal Data. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

K. California's "Shine the Light" law

California's "Shine the Light" law (Civil Code Section § 1798.83) permits California residents who use our Service to request certain information regarding our disclosure of Personal Data third parties for their direct marketing purposes. To make such a request, please send an email to the email address listed below.

L. Changes to this Privacy Policy

We reserve the right to update or modify this Privacy Policy from time to time. If we make any material changes to this Privacy Policy or the way we use, disclose, or collect Personal Data, we will notify you by revising the “Effective Date” at the top of this Privacy Policy, prominently posting an announcement of the changes on our Service, or sending an email to the email address you most recently provided us (unless we do not have such an email address) prior to the new policy taking effect. Users are bound by any changes to the Privacy Policy when they use our Service after notice of such changes has been communicated.
